Texas Penal Code

How Texas Grades Assault

Class C misdemeanor

Assault by contact or threat (Class C misdemeanor): offensive physical contact, or threatening someone with imminent bodily injury. It is fine-only, but it can still leave a record.

Class A misdemeanor

Assault causing bodily injury (Class A misdemeanor): up to one year in county jail and a fine of up to $4,000.

Third-degree felony (family violence)

Family violence assault with a prior conviction, or involving impeding breathing (third-degree felony): two to ten years in prison.

Third-degree felony (public servant)

Assault on a public servant (third-degree felony): applies when the person knows the alleged victim is a public servant performing official duties.

Second-degree or first-degree felony

Aggravated assault (second-degree felony, and in some cases first-degree): causing serious bodily injury, or using or exhibiting a deadly weapon.

Family Violence Charges Carry Extra Consequences

A family violence finding can stay on your record even in a misdemeanor case. It can be used to raise a future charge to a felony, it can trigger federal firearm restrictions, and it can come up in a divorce or custody case. After an arrest, a magistrate may also issue an emergency protective order or bond conditions that keep you away from your own home.

Our Approach

How We Defend Assault Cases

1

We gather the evidence early: 911 recordings, body camera video, photos, medical records and witness statements.

2

We evaluate self-defense and defense of others, which are legal justifications under Texas law.

3

We test whether the accusation is consistent with the evidence and the other witnesses.

4

We prepare every case as if it is going to trial, which puts us in the strongest position to negotiate.

What To Do After an Assault Arrest

Talk to a defense attorney before your first court date.

Do not discuss the incident with police, the other person or on social media.

Follow every bond condition, including any no-contact order.

Write down what happened and the names of any witnesses while your memory is fresh.
